Brizz.me Terms and Conditions

Last Updated: 2nd October 2025

These Terms and Conditions ("Terms") govern your use of the Brizz.me platform (the "Platform"), operated by Ananthya GmbH (HRB 137980, Address: Gerlachstr. 4, 65929 Frankfurt am Main, Germany), including the Brizz website and mobile applications. By registering an account or using any services on Brizz.me, you agree to be bound by these Terms. If you do not accept these Terms, you must not use the Platform.

1. Eligibility and Account Registration

  1. Age Requirement: The Platform is intended for users 16 years of age or older. By creating an account, you represent that you are at least 16 years old and legally capable of entering binding contracts. Accounts for persons under 16 are not permitted, and Ananthya GmbH reserves the right to terminate any account found to be in violation.
  2. Account Setup: To access Brizz.me services, you must register an account with accurate and complete information. Required data includes your full name, valid email address, mobile phone number, gender, date of birth, country, and city of residence. You agree to provide truthful information and keep it up-to-date (e.g. if you change your email or phone, update your profile promptly).
  3. Account Security: You are responsible for maintaining the confidentiality of your account login credentials. Do not share your password with others. You are liable for all activities conducted through your account. If you suspect unauthorized use of your account, notify us immediately. We are not liable for any loss or damage arising from your failure to secure your account.
  4. One Account Per Person: Each user may register only one account (except businesses may have distinct accounts for different entities or locations as authorized by Brizz). You may not transfer your account to someone else without our consent. We reserve the right to reject or reclaim usernames that impersonate someone else, infringe trademarks, or are deemed inappropriate.
  5. Account Verification: Brizz may, in its discretion, require identity or age verification documentation (such as government ID) to confirm that you meet eligibility requirements or before enabling certain features (e.g. high-value transactions or payouts). By signing up, you agree that we can undertake checks as permitted by law to verify your identity and compliance with these Terms.
  6. Communication Consent: By providing your contact information, you consent to receive service-related communications from Brizz (e.g. verification codes, transaction receipts, event updates) via email, SMS, WhatsApp, or other provided contact methods. These communications are considered part of the services. Marketing communications (newsletters, promotions) will be sent only in accordance with applicable law and can be opted out of separately.

2. Personal Data & Privacy

Brizz is committed to protecting your privacy in accordance with the EU General Data Protection Regulation (GDPR) and German data protection laws. Any personal data you provide to us will be collected, processed, and used as outlined in our Privacy Policy (Datenschutzerklärung). Key points include:

  1. Data Collected: When you register or use the Platform, we collect personal information such as your name, email, phone number, gender, date of birth, country and city, and any profile details you optionally provide. We also collect data from your usage of the Platform (e.g. listings you create or attend, messages sent, payment transactions).
  2. Purpose of Use: We use your data to provide and improve the Platform services. For example, your name and email are used to issue event tickets and send confirmations, your date of birth may be used to verify age for age-restricted events, your city may be used to show local events or services, and your phone number may enable connection via WhatsApp for communications with other users (with your consent). We will not use personal data for any purpose not compatible with those described, unless we obtain your consent or have another legal basis.
  3. Legal Basis: In most cases, we process your data to perform our contract with you (providing the requested services) or to comply with legal obligations (e.g. accounting records). In other cases, we may process data based on your consent (for example, optional demographic information) or our legitimate interests (such as ensuring platform security and fraud prevention), always weighing your privacy rights appropriately.
  4. Data Sharing: We will share your personal data only as needed for operating the Platform and fulfilling transactions. This includes sharing necessary details with other users when you engage in a transaction (for instance, if you purchase an event ticket, the event organizer will see your name for ticketing purposes; if you book a service or rental, the provider will see your contact details to arrange the service). We may also share data with third-party service providers who support our Platform (e.g. payment processors, IT hosting) under strict data protection agreements. We do not sell your data to third parties for their own marketing.
  5. User Rights: Under the GDPR, you have rights regarding your personal data, including the right to access the data we hold about you, to correct inaccurate information, to delete your data ("right to be forgotten"), to restrict or object to certain processing, and to data portability. You can exercise these rights by contacting us at the email provided in our Privacy Policy. Additionally, you have the right to lodge a complaint with a supervisory data protection authority if you believe your rights are being violated.
  6. Data Retention & Security: We retain personal data only as long as necessary for the purposes stated or as required by law (for example, transaction records may be kept for legal/tax reasons). We implement appropriate technical and organizational security measures to protect personal data against unauthorized access or loss. However, you understand that no system is 100% secure, and we cannot guarantee absolute security of data.
  7. Cookies & Tracking: Our Platform uses cookies or similar technologies to provide core functionality and analyze usage. For details, refer to our Cookie Policy in the Privacy Policy. By using the site, you consent to such technologies as described.
  8. Privacy Policy Incorporation: These Terms incorporate our Privacy Policy by reference. Please review the Privacy Policy for detailed information on how we handle personal data. By using the Platform, you acknowledge that you have read and understood the Privacy Policy and that you agree to Brizz's data practices.

3. Scope of Platform Services

Brizz.me is a global community and marketplace platform that provides three primary categories of services to users:

  1. Events Platform: Tools to create, list, discover, and purchase tickets for events (both in-person and online). Organizers (users who create events) can use Brizz’s own ticketing engine to sell tickets, or they can post events that redirect to external ticketing providers. Attendees (users who book tickets) can find and join events through the Platform.
  2. Services Marketplace: A classifieds-style marketplace where individuals or businesses ("Service Providers") can offer services (e.g. lessons, freelance work, personal services) and other users can find and hire them. Brizz facilitates the listing and discovery of services, and communication between parties.
  3. Rentals Marketplace: A listing service for rentals, such as property rentals, sublets, or venue rentals offered by hosts ("Rental Providers"). Users can find short-term accommodations or other rentals and connect with the providers. Brizz may facilitate booking arrangements but primarily acts as a venue for listings.

Brizz as an Intermediary: Brizz provides the technological platform to connect users but is not itself a party to the underlying contracts between users for events, services, or rentals. This means:

  1. Brizz does not own, create, control, or supply the events, services, or rental properties listed by users on the Platform. The actual contract for an event ticket purchase is between the event organizer and the attendee; for a service, between the service provider and the client; for a rental, between the rental provider (host) and the renter/guest.
  2. Brizz is not an event organizer, not a service provider/employer, and not a landlord or real estate broker. We do not endorse or guarantee the existence, quality, safety, legality, or suitability of any user-generated listing. All information about events, services, or rentals is provided by the user who posts it, and Brizz generally does not pre-approve or verify the content for accuracy or legality in advance.
  3. No Guaranteed Monitoring: While we reserve the right to remove or moderate content that violates these Terms or law, Brizz has no general obligation to monitor user content or to actively search for facts indicating illegal activity (in accordance with the German Telemedia Act and EU Digital Services Act). We rely on users to adhere to the rules and on notifications of misuse. Content or listings expressed by users are their own and do not represent Brizz’s opinions.
  4. Platform Improvements and Third-Party Integration: Brizz may provide features like messaging between users, search and filtering of listings, and integrations with third-party services (for example, map services for event locations or payment gateways). These features are provided to facilitate user interactions but do not change the fact that any agreement for a ticket, service, or rental is directly between users.

By using the Platform, you acknowledge the role of Brizz as a neutral intermediary. Brizz shall not be deemed a seller of tickets, an employer or contractor in services, nor a party to rental agreements, and Brizz assumes no responsibility for the contracts between users or the acts/omissions of any user or third party involved in those contracts. Your rights and remedies regarding an event, service, or rental you partake in are against the organizer or provider of that listing, not against Brizz, except as explicitly provided otherwise in these Terms.

4. User Obligations and Acceptable Use

We aim to foster a safe, trustworthy community. By using Brizz, you agree to the following general obligations and conduct standards:

  1. Compliance with Laws: You will abide by all applicable laws and regulations in connection with your use of the Platform. This includes (but is not limited to) laws relating to consumer protection, youth protection, data protection, intellectual property, tax obligations, and regulatory licensing requirements for certain activities. If you are offering a service or rental, you are solely responsible for identifying and obtaining any necessary licenses, permits, or registrations required by law (for example, a business license for professional services, landlord permission or city registration for short-term rentals, certification for specialized services).
  2. Accurate Information: When listing an event, service, or rental, you must provide complete, truthful, and not misleading information. This includes details like pricing, descriptions, location, timing, qualifications (for services), and any material terms or restrictions. Do not post false or fraudulent listings. If circumstances change (e.g., an event time is rescheduled, a service becomes unavailable), update the listing or notify affected users promptly.
  3. No Inappropriate Content: You will not post or transmit any content that is illegal, infringing, or violates any rights. Prohibited content includes:
  4. Content that is defamatory, harassing, threatening, or abusive towards others.
  5. Hate speech or content that discriminates based on race, ethnicity, national origin, religion, gender, sex, sexual orientation, disability, or any protected class.
  6. Obscene, pornographic, or sexually explicit material (with the exception of non-pornographic adult services listings where legal, which must still be appropriately tagged and compliant with law).
  7. Violent or graphic content that is gratuitous or inappropriate.
  8. Content that infringes intellectual property rights of others (e.g. posting images or text you do not have rights to, music in event videos without permission, etc.).
  9. Personal data of others published without consent, or any content violating privacy or data protection laws.
  10. No Prohibited Items or Services: You agree not to use Brizz for any transactions involving illegal or regulated goods or services. For example, you may not list or sell: weapons, controlled substances or drugs, stolen property, counterfeit items, illicit pornography, trafficking of animals, or any service that is inherently illegal (such as hiring someone for unlawful activities). If certain services are heavily regulated (e.g. financial services, medical services), you must ensure you are authorized and follow all rules; otherwise do not offer them on Brizz.
  11. No Spam or Unauthorized Advertising: You will not use the communication tools or listings to send spam, junk mail, pyramid schemes, or unsolicited commercial messages that are not relevant to the purpose of the Platform. Do not advertise other platforms or businesses in a manner that is not allowed (for example, posting a service listing just to redirect users to a different website is not permitted unless specifically allowed within a category).
  12. System Integrity: You will not introduce viruses, malware, or any harmful code to the Platform. You will not attempt to gain unauthorized access to our systems or data, or engage in any activities that burden or disrupt the normal functioning of the Platform (such as a denial-of-service attack, hacking, or scraping data beyond what is allowed).
  13. Respect Other Users: You agree to interact with others on the Platform respectfully. This includes showing up to events or appointments you commit to (or canceling in advance through proper channels), paying agreed fees, delivering services as promised, and resolving disputes in good faith. If you have a dispute with another user, try to communicate and solve it amicably. Harassment, aggressive behavior, or misuse of any review or rating system (like retaliatory ratings or false reviews) is prohibited.
  14. No Circumvention: You will not intentionally circumvent the Platform's processes or fees. For example, if you discovered a service provider or rental on Brizz, you should not complete the transaction off-platform in order to evade fees or terms, where Brizz provides an on-platform payment or booking option. (Note: This does not restrict normal communication or payment methods for services/rentals where Brizz does not provide an online payment system—those can be completed as agreed between users, but see Section 8 on the risks of off-platform payments).
  15. Multiple Accounts and Abuse: You will not create multiple accounts to manipulate the Platform (such as to post multiple identical listings, double-book events, or review yourself). You will not use any automated means (bots, scripts) to create accounts or post content without our approval. If your account is suspended or terminated, you agree not to create a new account without our permission.
  16. Reporting and Moderation: If you come across any content or user behavior that violates these Terms or appears illegal, you are encouraged to report it to Brizz via the provided channels (e.g., a "Report" button or contact email). We will review reports and take action as appropriate under these Terms and applicable law.

Brizz reserves the right to remove any content or listings that in our sole discretion violate these Terms or applicable law, or for any reason are deemed harmful to the integrity or reputation of the Platform. We may also suspend or terminate the account of users responsible (see Section 12 on Termination). We may disclose information about such content or behavior to law enforcement or other authorities if required by law or if necessary to address unlawful or harmful conduct.

By adhering to these rules, you help keep Brizz a safe and reliable community for everyone.

5. Event Listings and Ticketing

Brizz’s Events section enables users to host and attend events. The following terms apply specifically to event organizers and attendees using the Platform:

  1. Event Creation: Registered users can create event listings through Brizz. Events may be in-person (physical location) or online/virtual. When you create an event, you become the Organizer for that event and are responsible for all details provided (title, description, date and time, venue or online link, capacity, ticket price, etc.). All events must comply with our content policies and applicable laws (for example, events must not promote illegal activities or hate speech). Organizers should clearly disclose any important conditions for attendance (e.g. age restrictions, ID or dress code requirements, health/safety measures, etc.). You must have the rights and permissions for all content in your event listing (see Intellectual Property section) and for hosting the event at the specified venue (including any required permits, venue rental agreements, or licenses).
  2. Ticketing Options: Brizz offers multiple ticketing methods:
  3. Free Events: You can list events as free; attendees can RSVP/obtain a ticket at no cost.
  4. Paid Events via Brizz Payment: Brizz provides a ticketing engine for paid tickets. If you choose this option, attendees can purchase tickets directly on the Platform using supported payment methods (credit/debit cards, PayPal, etc. as processed by our payment partners). Brizz (via its payment processors) will collect the ticket price (and applicable taxes/fees) from buyers on your behalf and later remit proceeds to you as the Organizer (see Payouts below).
  5. Cash at Event (On-site Payment): You may list a paid event but designate that payment will be collected in cash (or other offline means) at the event venue. In this case, Brizz may still allow attendees to reserve a spot or RSVP via the Platform, but no online payment is taken by Brizz. The attendee will pay you (the Organizer) directly when arriving at the event. Important: Brizz is not a party to any cash transaction and cannot facilitate refunds or resolve payment disputes for offline payments. Choosing this method is at both Organizer’s and attendees’ own risk; Brizz disclaims all liability for any issues arising from cash or off-platform payments (e.g., no-show attendees or failure to pay, counterfeit money, etc.). We strongly encourage using Brizz’s integrated payment for a secure transaction record and protection.

  1. External Ticketing Link: If you prefer to sell tickets using an external platform or link (for example, Eventbrite, Meetup, or another ticket vendor), you can include that link in the event listing. In this scenario, Brizz acts solely as a listing directory and does not handle payment or ticket issuance. Attendees who click the external link will be subject to the terms and processes of that external ticket provider. Brizz is not responsible or liable for the transaction on external sites, and any purchase contract is between the attendee and the external provider/Organizer. However, as an Organizer, you must ensure the external link is valid, safe, and clearly leads to the correct event ticket page. Misleading links or those that cause harm (phishing, etc.) are strictly forbidden and will result in removal of the event and possible account suspension.
  2. Role of Brizz in Ticket Sales: For events using Brizz’s payment engine, Brizz acts as a facilitator to collect payments and issue digital tickets to attendees. Brizz is not the seller of the event or the organizer; you as the Organizer are the contracting party to attendees for event admission. Brizz may act as the Organizer’s limited payment collection agent for the purpose of accepting payments from attendees and passing those to the Organizer. This means a ticket buyer’s obligation to pay is fulfilled when Brizz (through its payment processor) successfully collects the funds on behalf of the Organizer. Organizers agree that they will provide the event as advertised to all attendees who have valid tickets, and attendees agree that all ticket purchases are binding. (See Refunds below for cancellation situations.)
  3. VAT and Ticket Pricing: If you sell tickets through Brizz, you are responsible for setting the correct ticket price inclusive of any applicable taxes. The Platform will provide fields to input a VAT rate (%) for your ticket (e.g. standard German VAT 19%, reduced 7%, or 0% if exempt). Brizz may display ticket prices as “€X (includes Y% VAT)” based on your inputs. Organizers are solely responsible for determining the correct VAT rate and meeting their tax obligations:

  4. For example, in Germany, most events are subject to 19% VAT, but certain cultural events may qualify for 7%, and some organizers (e.g. small businesses under the UStG §19 or certain non-profits) might not charge VAT. It is the Organizer’s duty to know which category their event falls under and set the rate accordingly.
  5. You must provide a valid VAT Identification Number (USt-IdNr.) if you are a business required to have one. If you claim a reduced VAT rate or exemption, you should be prepared to provide Brizz with documentation or legal justification upon request (e.g. proof of small business status or type of event qualifying for reduction).

  6. Brizz’s Role in VAT: Brizz is not the seller of record for tickets and does not declare VAT on the ticket sales as its own revenue. We simply provide the technical infrastructure to collect and (if applicable) separately display the tax on tickets based on Organizer input. The collected amounts (ticket price and any tax component) will be passed to the Organizer in payouts. The Organizer is responsible for remitting the appropriate tax to authorities and issuing invoices/receipts to attendees if required by law. Brizz disclaims liability for incorrect tax settings or tax filings by the Organizer. If Brizz is mandated by law in any jurisdiction to collect and remit tax on ticket sales, the Organizer agrees to cooperate and provide necessary information (and Brizz will notify the Organizer and handle such tax as required, e.g. certain places require marketplaces to collect tax on behalf of sellers).
  7. Brizz may show tax identification on tickets or receipts as needed. If requested by an attendee, the Organizer should provide an invoice including their VAT ID and tax breakdown. Brizz can assist by providing sales reports, but we do not issue tax invoices on the Organizer’s behalf (unless required and arranged).
  8. Payouts to Organizers: For paid events using Brizz’s payment system, Brizz will remit the ticket proceeds to the Organizer’s designated payout account (e.g., bank account connected via Stripe or PayPal) after deducting any applicable service fees (if any) and payment processing fees. Payouts are scheduled at regular intervals: every 5 days after your ticket sales start. This means, roughly, every 5 days we will calculate the net ticket revenue accumulated and initiate a payout to you. (For example, if your event tickets go on sale on the 1st of the month, payouts might occur on the 6th, 11th, 16th, etc., covering sales in each period.) The exact timing may depend on bank processing times and any holds for new accounts.
  9. Payout Conditions: Payouts are subject to successful payment capture from buyers and are processed via our payment partners (Stripe, PayPal, etc.). If a payment from a buyer is pending, fails, or is disputed/chargebacked, those funds will not be included in payouts (or may be deducted from a future payout if already released). Brizz may delay or hold payouts in cases of suspected fraud, violation of Terms, or upon notice of potential event cancellation or disputes, until resolved.
  10. Organizer Fees: Brizz may charge Organizers a small service fee or commission per ticket sold for using our ticketing platform (the specifics will be communicated in advance, e.g. X% of ticket price or a flat fee). Any such fees are either added on top of the ticket price for the buyer or deducted from the payout. We will disclose how fees are handled when you set up ticketing. For transparency, attendees will see any booking fee at checkout if it is passed on. By using Brizz ticketing, you agree to pay these fees. Third-party payment processing fees (like credit card transaction fees) may also be deducted.
  11. Currency: All ticket transactions are in the currency indicated on the event listing (the Platform will generally use Euro (€) for events in Germany, but may allow other currencies for events elsewhere). If Brizz allows multi-currency, we will either settle payouts in the Organizer’s local currency or in the currency of the event, as communicated. Exchange rate or conversion costs may apply if currency conversion is needed.
  12. Attendee Refunds & Cancellations (Organizer Cancellation): As an Organizer, you are expected to hold your event as advertised. However, if you cancel an event or significantly change it (e.g. change date/location in a way attendees cannot attend), the following rules apply:
  13. Organizer-Initiated Cancellation: You must promptly notify all ticket holders and Brizz if you need to cancel the event. Brizz will then process full refunds to all attendees who purchased tickets through the Platform (including any ticketing fees). Refunds will be issued to the original payment method used by the attendee. Attendees do not need to take action to get this refund (though timing might vary by bank).
  14. Return of Payouts: If you (Organizer) have already received payout(s) for tickets of a now-cancelled event, you are obligated to return those funds to allow refunds. Brizz may invoice you for the amount to be returned or deduct it from your connected payment account automatically if possible. You agree to cooperate in returning any payouts for cancelled or non-performed events. Failure to return funds for refunds is a serious violation; Brizz reserves the right to take legal action to recover amounts and may use any security deposit or reserve withheld, or offset against other payouts. The Organizer, not Brizz, bears any costs of refunding attendees in case of cancellation.
  15. Brizz-Initiated Cancellation: Brizz also reserves the right to cancel an event on the Platform (and issue refunds) if we have a strong reason, such as discovering the event is fraudulent, illegal, or the Organizer breached these Terms. We will attempt to coordinate with the Organizer in such cases, but our priority is to protect attendees and the community.
  16. Postponements: If an event is postponed (rescheduled to a different date), the Organizer should inform attendees of the new date and offer them the choice to either attend on the new date or request a refund. In general, attendees are entitled to a refund for a material date change, but if an attendee agrees to the new date, the ticket remains valid. Brizz can facilitate refunds for those who cannot attend the new date if the event was ticketed on our Platform. Organizers should not unreasonably refuse such refund requests in case of date changes.

  1. Attendee-Initiated Cancellations: If an attendee can no longer attend an event they paid for, the refund policy depends on what the Organizer set and communicated (Brizz allows Organizers to specify a refund policy for change-of-mind or personal reasons, e.g. "no refunds", or "refunds allowed up to X days before event"). Brizz will enforce the stated refund policy on the event listing. If an attendee is entitled to a refund per that policy, they can request it through Brizz’s tools or by contacting us/Organizer, and we will process it accordingly. If the policy is "No refunds", attendees typically cannot get a refund unless the event is canceled or under some exceptional consumer rights scenario. Note: Under EU/German consumer law, ticket purchases for leisure events on a specific date are generally exempt from the 14-day withdrawal right (Widerrufsrecht). This means consumers cannot simply cancel and demand a refund for a concert or event ticket bought online, outside of the Organizer’s stated refund policy or event cancellation. All sales are usually final, so please only book if you intend to attend. Brizz may nonetheless assist with goodwill refunds in certain hardship cases at the Organizer’s discretion, but this is not guaranteed.
  2. No Right of Withdrawal for Event Tickets: In line with the above, purchases of tickets for events scheduled on a specific date or period are not subject to the statutory 14-day consumer withdrawal right under German law (§ 312g Abs.2 No. 9 BGB), as these are leisure services for a set date. Therefore, aside from Organizer's own refund policy or event cancellation, you do not have an automatic right to cancel an event ticket purchase. (If an event does not have a fixed date at the time of purchase – e.g., an open-ended voucher – different rules might apply, but most Brizz events will be date-specific.)
  3. Event Conduct and Liability: As an attendee, you must adhere to any rules set by the Organizer for the event (e.g. venue rules, safety instructions). You are responsible for your own transportation to the venue and your personal belongings during the event. Organizers should carry out their events with due care for attendees’ safety. Brizz is not responsible for incidents or injuries that occur at events, as it is not the event host. Organizers are encouraged to have their own liability insurance for events if appropriate. Any claims or issues (such as personal injury, property damage, or dissatisfaction) that arise from the event shall be resolved between the attendee and Organizer. Brizz’s role is only to facilitate the booking and payment, we do not supervise events and cannot guarantee their quality or safety. However, we welcome feedback and if you report serious issues about an Organizer or event, we may take appropriate action on our Platform (such as investigating, suspending the Organizer’s account, or notifying authorities if laws were broken).
  4. Third-Party Event Providers: Sometimes, Brizz or Organizers might list events by third-party providers (like linking to a Meetup event or a Ticketmaster listing). Brizz is not liable for those external events. If you encounter any issues (for example, the external event is canceled or the tickets from an external site are invalid), you must address those with the actual provider. Brizz’s responsibility ends at providing the initial information and link.
  5. Event Organizer Additional Obligations: If you are an Organizer, you further agree to:

  1. Indemnify Brizz for any claims from attendees or third parties due to your event (see Indemnification section). For instance, if you fail to deliver what was promised and an attendee sues Brizz or demands compensation, you will cover Brizz’s costs.
  2. Not use attendee data obtained through Brizz for purposes outside the event without consent. You can contact attendees for event-related communications (schedule, instructions), but you should not spam them with unrelated offers. Also adhere to privacy laws if you retain their data.
  3. Ensure any promotion or sponsorship associated with your event does not conflict with Brizz’s policies. You may display your own sponsor logos on your event page if you have rights, but Brizz is not involved in those sponsorships.
  4. Not collect additional fees at the event beyond what was agreed (except perhaps optional things like merchandise or food, but core entry should match what the ticket covered).
  5. Follow any applicable consumer protection laws, for example: if an event is canceled, refund promptly; if there are significant changes, allow refunds; do not engage in deceptive advertising (the event should match its description). Also, do not discriminate in allowing attendance (respect equality laws – e.g. open public events should be open without unlawful discrimination).
  6. Provide necessary customer support for your event. Attendees may have questions, and while Brizz can assist with technical ticket issues, content questions should be handled by you as Organizer.

In summary, Brizz facilitates event discovery and ticket transactions but the event itself is solely the Organizer’s responsibility. Organizers and attendees must deal in good faith, and any allocation of risk is as set out above and elsewhere in these Terms.

(For professional event organizers: please also see Section 8 on payments, and Section 11 on liability disclaimers which apply to your use of the Platform.)

6. Services Marketplace

Brizz’s Services Marketplace allows users to offer and find various services. Brizz itself is not providing these services; it merely provides a venue for service providers and potential clients to connect. The following terms apply:

  1. Service Listings: As a Service Provider, you can create listings describing the service you offer (e.g., tutoring, event photography, catering, handyman work, etc.). You must accurately describe the service, including what is offered, pricing or rate (hourly, fixed, etc.), your qualifications or credentials (if relevant), and the area or location you serve (if applicable). Do not list services that are illegal or that you are not actually able or certified to perform. If a service is subject to legal requirements (for example, childcare services, driving services, medical or therapeutic services), you must have and maintain all necessary licenses, certifications, or insurance required to lawfully offer that service. Brizz does not pre-approve each listing, so the responsibility is on you to comply with the law and the truthfulness of your listing.
  2. No Brizz Guarantee or Endorsement: Brizz does not screen or certify service providers in advance. We do not guarantee that any provider has the skills, experience, or permits they claim. There are no warranties from Brizz regarding the services offered by users. Any agreements for a service are made solely between the provider and the client user. Brizz does not endorse any particular user or service, and providing a platform for user reviews or ratings does not mean we vouch for the accuracy of those reviews or the quality of service. Use your discretion and, if needed, conduct your own vetting (e.g. ask for references, proof of license, etc.).
  3. Communication and Booking: Users can contact service providers through the Platform’s messaging system or via provided contact info to discuss details, availability, and terms. Brizz may in future provide a booking/payment feature for services; if so, that will be governed by Section 8 (Payments). Otherwise, users are free to arrange payment and logistics directly with each other. However, any off-platform payment is at your own risk (see Section 8 about off-platform transactions). It's advisable to have a clear agreement in writing (even via Brizz messages) on the scope of service and fees to avoid disputes.
  4. Provider Obligations: If you offer a service, you agree to:
  5. Perform the service with reasonable care and skill, as described in your listing and agreed with the client. Be punctual and professional.
  6. Only offer services that you are qualified and legally allowed to provide. Upon request by Brizz, you should be ready to present proof of qualifications or eligibility (e.g., professional license, insurance policy, portfolio of work). If you refuse or cannot provide such proof and we have concern, we may remove your listing or suspend your account.
  7. Determine and comply with any tax obligations resulting from the services you provide. You are responsible for reporting and paying any income tax, VAT, or other taxes owed on the fees you earn. Brizz is not your employer; you act as an independent contractor or business.
  8. Not misrepresent your identity or use multiple accounts to boost your own listing or ratings.
  9. Handle client personal data with care: any information you learn about a client (address, phone, etc. for performing the service) must be used only for that service and kept confidential and secure.
  10. If a client cancels or reschedules a booking, try to accommodate if reasonable, but also set a clear cancellation policy in your listing if you have one (e.g., no fee for cancellations 24h in advance, etc.). Similarly, if you need to cancel on a client due to an emergency, inform them as soon as possible and refund any deposit if applicable.
  11. Client (Service Seeker) Obligations: If you are hiring a service provider:
  12. Provide accurate information about your requirements and expectations. For example, if you need a service at a specific time or location, give the correct details.
  13. Ensure that engaging this service is legal (certain services might require you to have permissions too, like if you hire someone to do work on a rented property, you need landlord permission, etc.).
  14. Pay the agreed fee as and when due. If using Brizz’s payment system, follow those procedures; if paying cash or other means, transact in a safe manner.
  15. Treat providers with respect and comply with any reasonable rules they have (for instance, if you hire a personal trainer, follow safety guidance; if a tutor has a cancellation policy, honor it).
  16. Understand that the provider is not a Brizz employee. Brizz is not responsible if you are unsatisfied with a service, but we encourage you to leave honest feedback/reviews to guide the community.
  17. No Agency: Using the Marketplace does not create an employment, agency, or joint venture relationship between Brizz and any user, nor between users inter se via Brizz. Providers are not agents of Brizz, and cannot make Brizz contractually or legally responsible for anything. Brizz does not direct or control how a provider performs their service; any arrangement is solely between the users involved.
  18. Disclaimers and Liability: Brizz disclaims all liability for the outcomes of services arranged through the Platform. We are not liable for any injury, loss, or damage that occurs during or as a result of a service appointment. For example, if you hire a repair person from Brizz and they damage your appliance, that is a matter between you and the repair person. Or if you are a provider and the client’s pet bites you, that is between you and the client. That said, we do care about trust and safety:
  19. You can rate and review each other after a service. Reviews should be truthful and fair (see Community Guidelines about reviews). They are publicly visible to help others. We do not remove reviews unless they violate our content rules (like hate speech or irrelevant spam).
  20. If something very serious happens (like criminal conduct), we may intervene by suspending a user or assisting law enforcement as appropriate, but Brizz does not arbitrate routine service contract disputes. Those should be resolved via communication, or if needed, legal avenues between the parties.
  21. No Warranty: Brizz makes no warranty that services posted on the Platform will meet your expectations or that the provider will be competent or results will be satisfactory. Any remedies must be sought from the contractual counterparty (provider or client).
  22. Removal of Listings: Brizz may remove or edit service listings that we find to be in violation of these Terms or that receive multiple serious complaints. We may also limit a user’s privileges if their average ratings are very poor or we suspect misconduct. We will generally notify the provider if we remove their listing unless legal reasons prevent it. Providers have the ability to edit or delete their own listings at any time as well.

By participating in the Services Marketplace, you accept that Brizz’s role is limited to an information-sharing platform, and you proceed at your own risk. Use common sense and due diligence when engaging in any service through Brizz.

7. Rentals Marketplace

Brizz’s Rentals Marketplace connects people offering rental opportunities with those seeking them. Common uses might include short-term home or room rentals (similar to Airbnb-style sublets), venue rentals for events, or other equipment/property rentals. The following terms apply:

  1. Rental Listings: A user who lists a rental is a Rental Provider (Host). You may list properties or spaces you have the legal right to rent or sublet (e.g., an apartment, a room in your house, a parking space, a party hall, etc.), or items you want to rent out (e.g., camera equipment, tools—though note that item rentals entail similar obligations). The listing must accurately describe the rental, including location, type of space/item, availability dates or times, rental price (and what that price includes, such as utilities, cleaning, etc.), security deposit requirements if any, cancellation policy, house rules or usage rules, and any other important details (like maximum occupancy, whether pets or smoking are allowed, need for insurance, etc.).
  2. Right to Rent and Legal Compliance: By listing a rental, you represent and warrant that you have the right to do so. For real property: if you are the owner, great; if you are a tenant or leaseholder subletting, ensure your lease or local law allows it (many cities require landlord permission or even municipal registration for sublets or short-term rentals, like the Zweckentfremdung laws in some German cities). Providers must comply with local laws on rentals (for instance, some places require collecting tourist taxes or have limits on short-term rental days). You are solely responsible for understanding and following all laws and rules applicable to your rental. This could include zoning regulations, homeowners’ association rules, tenant-landlord laws, safety standards (e.g. functioning smoke detectors), obtaining any necessary permits or insurance. Brizz does not verify these; we rely on you. If Brizz requests, you should furnish evidence of your right to rent (for example, a proof of ownership or a letter of permission). If you cannot, we may remove the listing.
  3. No Brizz Ownership or Management: Brizz is not a real estate broker, property manager, or insurer. Brizz does not own or manage rental properties listed by users, and is not party to rental agreements. We do not verify the physical condition of properties or items, and we do not guarantee that a listing is available or will be as described. Any rental contract (whether written or verbal) is directly between the Host and the renter (Guest). Brizz acts only as a facilitator if you use our messaging or booking tools.
  4. Booking and Payment: Depending on platform features, rental bookings might be handled in a couple of ways:
  5. If Brizz offers an on-platform booking request system, a prospective renter can send a booking inquiry or request to the Host for specified dates. The Host can accept or decline. If accepted, possibly payment can be processed via Brizz’s payment partners. In such case, similar to events, Brizz might act as an agent to collect payment and then release it to the Host after deducting fees. We will outline those specifics if/when that feature is active. Essentially, it would parallel how Airbnb handles payments (money held until check-in date then paid to host).
  6. If Brizz does not process payments for rentals, then users will arrange payment offline. If offline, consider using safe methods (perhaps meet in person for keys exchange and then pay, or sign a rental agreement). Brizz is not responsible for payment issues offline, and cannot help recover unpaid rent or damages (that's between the parties or their insurers).
  7. Hosts should clearly state in the listing how payment is to be made (and any deposit and refund conditions). If on-platform payment is available and the Host chooses it, then Section 8 applies to those transactions with appropriate modifications (payout likely after rental starts, etc.). If off-platform, Brizz encourages a written rental agreement for clarity and recommends exchanging IDs for security, but we do not mandate it.
  8. Security Deposits and Damage: If a Host requires a security deposit for potential damage, this must be disclosed up front in the listing (including amount and how it will be collected/returned). Brizz may in the future facilitate holding a security deposit via a payment hold, but currently, it might be done offline between Host and Guest. Both parties should inspect the property/item at handover and agree on its condition to avoid disputes later. Any damage during the rental period should be reported promptly. Brizz is not part of damage claims; if a Host claims the Guest caused damage, they must work it out together (we encourage documentation like photos, and a fair deduction from the deposit if justified). If they cannot agree, it becomes a legal matter between them. Brizz will not arbitrate, but repeated incidents or clear abuse by a user could lead to suspension of that account.
  9. Host Obligations: As a Host listing a rental, you agree to:
  10. Provide a safe, clean, and as-advertised property or item to the Guest. It should be available on the agreed dates/times, and you (or your representative) should be on time for key exchange or access provision.
  11. Not discriminate against potential renters on unlawful grounds (e.g., rejecting someone solely based on race or religion is not allowed as per our nondiscrimination policy and applicable laws). You can set objective criteria (like no pets, or maximum 4 people, or adults 21+ for a rental, etc., if reasonable and legal).
  12. If you cancel a confirmed booking at the last minute without good cause, understand that this causes inconvenience. Brizz may penalize such behavior by demoting your listings or, if repeated, removing you from the platform. Only commit to rentals you intend to honor.
  13. Ensure the property meets basic safety requirements (functional locks, emergency exits, no known extreme hazards, etc.). If there are particular hazards or quirks (e.g., steep stairs, low ceiling, pet on premises), disclose them so Guests are informed.
  14. After the rental, return any deposit promptly minus any legitimate deductions for damage (with receipts or proof if possible).
  15. Comply with tax laws (e.g., declare your rental income; if you must collect occupancy tax from Guests, either include it in your price or clearly communicate it. If Brizz provides a mechanism for occupancy tax, use it accordingly).
  16. Indemnify Brizz for any claims as per Section 11. For example, if a city fines Brizz because you failed to register your rental, you’d be responsible for that.
  17. Guest (Renter) Obligations: As a renter using the platform (Guest):
  18. You must provide accurate information about yourself and the purpose of the rental if asked (e.g., some Hosts want to know if it's a family vacation vs. a party). Be honest; if you plan a gathering, make sure it's allowed.
  19. Treat the property or item with care and respect, as if it were your own or per any house rules provided. You must not cause nuisance to neighbors or use the rental for illegal purposes.
  20. Adhere to check-in/check-out times or any other arrangements with the Host. Communicate promptly if issues arise (like you will be late or if something in the property is not working properly).
  21. You are responsible for any damage beyond normal wear and tear that you or your invitees cause during your stay/rental period. Notify the Host of damages. You may be liable to pay for repairs or replacements. If a security deposit was taken, the Host may use it; if not or if insufficient, Host may bill you. By agreeing to these Terms, you acknowledge such liability. Consider obtaining travel/rental insurance if the value is high or for peace of mind.
  22. At the end of the rental, return the property/item in the condition you received it (reasonably clean and undamaged) and return any keys or access devices as instructed.
  23. Pay all fees, including any required taxes or deposits, as agreed. If you fail to pay or your payment method is rejected, the booking may be canceled, and you could be removed from the platform for non-payment.
  24. Platform Fees for Rentals: Brizz may charge a service fee to Hosts and/or Guests for rentals booked through the platform, similar to other rental platforms (for example, a percentage of the booking or a fixed fee). If so, it will be clearly shown at booking checkout. Such fees help cover our platform operation and are typically non-refundable (except if the entire booking is canceled/refunded). By using the platform, you agree to any such fees presented at checkout.
  25. Liability and Disclaimers for Rentals: As with other sections:
  26. Brizz is not liable for personal or property damage during a rental, theft, accidents, or any disputes between Host and Guest. For instance, if a Guest is injured on a property or a Host finds their property damaged, that is outside Brizz’s responsibilities; those issues must be resolved by the insurance or legal claims of the parties.
  27. No Guarantee: We do not guarantee that each rental experience will be satisfactory or that Hosts/GGuests will perform as promised. There is an inherent risk in renting out property or staying at someone else's place. Users assume that risk. Brizz's role is limited to assistance in discovery and (potentially) payment facilitation.
  28. Host Guarantee or Insurance: Brizz does not provide host insurance or damage protection by default (unlike some platforms that offer limited guarantees). It is the Host’s responsibility to insure their property as needed and the Guest’s responsibility to have travel/renters insurance if desired. We strongly recommend Hosts verify whether their homeowner or renter insurance covers short-term rental activities (as some might not, or require notice).
  29. Review System: Hosts and Guests can review each other after the rental. This community feedback helps accountability. Be honest and factual in reviews. Brizz may investigate if someone tries to extort for a positive review or something unethical. We might remove reviews that are proven false or abusive, but generally reviews stand as opinion.
  30. If you encounter a severe issue (e.g., you arrive and the property does not match the description materially, or a Guest uses a stolen credit card), contact Brizz support. While we are not contractually liable, we may at our discretion try to mediate a solution, especially if payment went through us (like possibly finding alternate accommodation for a guest if a host no-shows, or withholding a payout if a property was misrepresented). However, these are goodwill measures and not guaranteed rights.

In summary, the Rentals Marketplace is built on trust and self-responsibility. Brizz simply provides the connecting platform and basic tools, but does not become part of the rental contract. Both Hosts and Guests should exercise due caution—verify identities, communicate clearly, and be aware of their rights and duties. By using this service, you acknowledge that Brizz’s liability is limited as described in Section 11 and elsewhere, and that you primarily rely on the other party’s integrity and any legal protections available outside of this contract.

8. Payments and Refunds

Brizz integrates third-party payment services to facilitate transactions on the Platform. The following applies to any payments made or received through Brizz:

  1. Payment Processors: Brizz uses external Payment Service Providers (PSPs) such as Stripe, PayPal, and SumUp to handle online payments. When you pay for an event ticket or a booking through Brizz, your payment details are processed by these providers, not directly by Brizz. By using Brizz’s payment options, you also agree to the terms and conditions of the respective PSP (for example, the Stripe Connected Account Agreement if you receive payouts as an Organizer, or PayPal’s User Agreement when you use PayPal, etc.). These external terms are in addition to our Terms, and in case of any issue with the payment processing, some matters may be governed by those PSP terms. Brizz is not a bank or financial institution; we do not hold deposits except temporarily to pass them from buyers to sellers as a facilitator.
  2. Security of Payments: We do not store full credit card numbers on our servers. All card transactions are secured through PCI-compliant providers. You should only make payments through the official Brizz checkout process. We will never ask for your credit card details via email or chat. If you suspect any fraudulent payment activity, notify us and your card issuer immediately.
  3. Fees and Pricing Transparency: When making a payment on Brizz, you will see the total price, including any applicable taxes (VAT) and any service fees. Brizz aims for transparency: for example, event tickets might show the ticket face value plus any “Brizz fee” and tax. As a buyer, you agree to pay the total amount indicated at checkout. As a seller (Organizer or provider), you agree that the payouts you receive will be net of any fees disclosed (Brizz service fees, payment processing fees, etc.). We reserve the right to modify our fee structure, but any changes to fees would not affect transactions already initiated and would be communicated for future transactions.
  4. Off-Platform Transactions Discouraged: Brizz disclaims liability for any payments conducted outside of our Platform. If you, as a user, choose to pay another user in cash, by direct bank transfer, or any method outside the Brizz checkout for a service/event/rental that was initially arranged on Brizz, you assume all risk. Brizz’s secure payment systems often provide certain protections (like record-keeping, fraud prevention, potential refunds for cancellations) that will not apply if you go off-platform. For example, if an event Organizer asks you to PayPal them directly as friends/family or bring cash, and then the event is canceled or they disappear, Brizz will not be able to assist in recovering your money. We strongly recommend keeping payments on-platform where available, for your safety and to ensure our policies (like mandatory refunds on event cancellation) can be implemented. If a user consistently attempts to circumvent our payment system, their account may be reviewed for suspension, since that undermines trust and our business model.
  5. Refunds Policy: Refunds on Brizz are handled as follows:
  6. For event tickets: See Section 5 (Event Refunds). In summary, if an event is canceled by the Organizer or by Brizz, buyers get a full refund via the original method (credit card reversal, etc.). If a buyer is entitled to a refund per the Organizer’s policy (or consumer law), we will process it accordingly. Refunds will be issued back to the source (so if you paid by credit card, the refund goes to that card; we cannot usually send it to a different account). It may take a few business days for the credit to appear, depending on your bank. If fees were charged, those are generally refunded as well when due to cancellation. Brizz’s own service fee will also be refunded if the whole order is refunded (we do not profit from canceled events).
  7. For services and rentals: If payment was done through Brizz, any refund would depend on the agreement between the parties and circumstances:
  8. If a service provider or host cancels before providing the service/rental, the client/guest will get a full refund of any amount paid. We will release that money back to them (the provider will not be paid for a canceled job).
  9. If a client/guest cancels, any refund depends on the cancellation policy set by the provider or host. Brizz will follow what was agreed: for instance, if free cancellation until 48 hours prior was the rule, and the guest cancels earlier than that, we refund accordingly (minus any non-refundable fees disclosed). If they cancel late and the policy says “no refund”, the provider may be entitled to keep the payment and no refund will be issued (except possibly cleaning fee or security deposit which should be returned).
  10. If there’s a dispute about the quality or completion of a service, and payment was held by Brizz (in an escrow-like manner), Brizz might hold off payout until resolved. Ultimately, however, we do not adjudicate who is right in a quality dispute; we encourage the parties to reach an amicable solution. Absent resolution, we might release funds per original agreement, or in rare cases, split, or as directed by a court decision if it goes that far.
  11. Any platform fees (Brizz service fee) for partially completed services might not be refunded if the service was partly delivered, except in truly canceled cases. We evaluate case by case.
  12. Chargebacks: If you initiate a chargeback or payment dispute via your bank for a transaction that occurred on Brizz, we will provide information to the payment processor to contest it if we believe it was a valid transaction. While you have rights under your card issuer, please note that unjustified chargebacks (for example, trying to claim fraud even though you attended an event) could result in account termination. For providers, if a buyer successfully chargebacks a payment, that amount (and related fees) will be deducted from your payout or future payouts. We’ll inform you and you can provide evidence to fight the chargeback through us.
  13. Third-Party Payment Terms Reference: For convenience, here are links to key payment terms that may apply (you should review them when using those services):
  14. Stripe: and (these cover using Stripe via our platform).
  15. PayPal: PayPal User Agreement (varies by country).
  16. SumUp: SumUp Terms for merchants (if relevant).
  17. By agreeing to Brizz Terms, you also agree that we can share necessary information with these payment providers (such as your email, IP address, device info, transaction details) to facilitate payments, detect fraud, and comply with their legal obligations (like anti-money laundering checks).
  18. Cash Transactions Disclaimer: To reiterate, any cash or direct payment between users is not protected or tracked by Brizz. For example, if you pay cash at an event or pay a service provider in cash, Brizz will not have a record to assist you with if something goes wrong. We do not assume any liability for losses in such cases. Users engaging in cash deals should be cautious: meet in safe locations, consider using receipts, etc., but that is outside our platform’s scope.
  19. Currency Conversion: If Brizz allows cross-currency transactions (e.g., you are in the EU paying for something listed in USD), we or the payment provider will show you the converted price or the currency we charge. There might be a conversion fee or rate applied. We aim to use a fair market rate, but note that your own bank might charge additional foreign transaction fees if applicable. Brizz is not responsible for those bank fees.
  20. Payment Issues: If a payment fails (card decline, insufficient funds, etc.), for purchases, the order will not be completed. If a payout to a provider fails (e.g. incorrect bank details), we will ask you to update info and will retry. There could be fees for repeated failed payouts that we might pass on if due to wrong info (we'll let you know). You must use payment methods that belong to you or that you are authorized to use. We may block or cancel transactions that we suspect are fraudulent or unauthorized.
  21. Receipts: Buyers will receive a confirmation email for any purchase made via Brizz, which can serve as a receipt. Organizers or providers should not issue separate invoices including VAT unless required, in which case they should ensure no double taxation (coordinate on who collects VAT as discussed in Section 5 under VAT).
  22. Tipping: If the Platform introduces a tipping feature (for services, etc.), tipping is voluntary and goes entirely to the provider minus any necessary payment fees. Tips are non-refundable once given, except in cases of fraud.

In summary, Brizz facilitates payments but does not itself guarantee the payment or assume risk beyond forwarding funds. We strive to maintain a secure and user-friendly payment system, but all users should transact carefully. If you have any questions or issues regarding a payment on the Platform, you can contact our support for assistance, and we’ll do our best to help within the scope of our role.

9. Intellectual Property and Content Rights

Brizz respects intellectual property rights and expects users to do the same. This section outlines how content is handled on the Platform:

  1. Brizz Platform IP: The Platform (including our website design, the Brizz name and logo, software code, and all content created by us) is protected by copyright, trademark, and other laws. Ananthya GmbH (Brizz) retains all rights, title, and interest in the Platform and its content, features, and functionality, except for content provided by users. You may not copy, distribute, modify, or create derivative works of our proprietary content without explicit permission. You are granted a limited, revocable license to use the Platform for its intended purpose (e.g., browsing listings, creating listings) but not for any commercial exploitation outside the Platform. All Brizz™ trademarks, logos, and service marks are our property; you cannot use them without our prior written consent, except as necessary for attributing or referring to Brizz (for example, you can say "I listed this on Brizz" in a factual sense).
  2. User-Generated Content: When you upload, post, or publish any content on Brizz (for example: event descriptions, photos, profiles, service listings, feedback, logos of your event sponsors, etc.), you retain ownership of that content. Brizz does not claim ownership of your works. However, by submitting content, you grant Brizz a worldwide, royalty-free, sublicensable, non-exclusive license to use, reproduce, adapt (reformat or resize, not alter the actual meaning), publish, translate, distribute, and display that content for the purpose of operating, promoting, or improving the Platform. This license enables us, for instance, to display your listing on our site and apps, to use snapshots of your public listings in marketing to attract more users, or to syndicate listings to partner websites for greater reach. We will not sell your content to third parties or use it outside of platform-related purposes without further permission. This license lasts as long as your content is available on our Platform, and for a reasonable time thereafter (e.g., even if you delete the content, we might retain backups or keep it if it has been shared to partners until those caches update, and we may keep copies for legal archival).
  3. Your Responsibilities for Content: You represent and warrant that you have all necessary rights to any content you post. Do not upload content that you do not have permission to use. For example, if you post a photo, you should either own the photo or have the photographer's permission. If you're using a company’s logo to promote a sponsored event, you must have the right to do so. If you post music or videos, ensure you have proper licenses. You agree not to post content that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party. You also agree not to post others' personal data in violation of privacy rights. If we receive a report or have reason to believe that any content violates these rules or someone’s IP, we may remove or disable that content.
  4. Copyright Infringement Policy (DMCA/EU Copyright Directive): If you believe that any content on Brizz infringes your copyright, you can send us a takedown notice. The notice should include: identification of the work you claim is infringed, identification of the content on our site that is infringing (with URL/link or event name), your contact info, a statement that you have a good-faith belief the use is not authorized, and your sworn statement that the info is accurate and you are the copyright owner or agent. For fastest response, email this to our designated copyright agent (contact info provided on our website’s legal section). We will promptly remove or disable access to the allegedly infringing content and notify the user who posted it. That user will have the opportunity to send a counter-notice if they believe it's a mistake or fair use. Our policy, in accordance with the DMCA and similar laws, is to remove repeat infringers from the Platform in appropriate circumstances.
  5. Note: For other IP like trademarks: you can similarly report misuse of your trademark, and we will review and take action if warranted (for instance, if someone is using your company name in a way likely to confuse or is counterfeit).
  6. Content Monitoring and Removal: While Brizz does not pre-screen all user content, we reserve the right (but not the obligation) to monitor and review content at any time. Our community and automated tools might flag content that looks suspicious or violating. Brizz may remove, edit, or disable access to any user content that we consider, in our sole judgment, to violate these Terms or the law, or to be otherwise harmful, without prior notice. We are not liable for any loss of data or earnings that might result from content removal. For transparency, if we remove content, we will generally inform the content uploader of the removal and the reason, unless it’s prohibited by law (like we are legally required not to notify, or if it would jeopardize someone). Under the EU Digital Services Act, you have a right to contest our content moderation decision: if you feel your content was wrongly removed, you can contact our support or follow the appeal process outlined in our help center. We will review appeals promptly and reinstate content if the removal was in error.
  7. Usage of Content by Brizz and Third Parties: You agree that Brizz can display your public content in various ways, including within the Platform, in emails or notifications relevant to other users (e.g., "New event in your city" featuring your event image), or on social media channels of Brizz for promotion. We might also allow trusted partners to show your listings on their sites (for example, a local tourism site showing events from Brizz). Your content will always be attributed to you (by username or event name) when we share it this way; we won’t pretend it’s ours. If we create derivatives (like cropping an image or translating a description to another language for a bilingual user), those are also covered by the license you gave us. You can opt out of certain promotional uses by contacting us if you have concerns, but general listing distribution is part of how Brizz expands your reach.
  8. Third-Party Content on Brizz: The Platform may have content provided by other users or third parties (like a payment provider’s widget, or map data, etc.). All user content is the responsibility of the user who posted it. We do not guarantee its accuracy or reliability. If you rely on any content (say, an event listing’s details), you do so at your own risk. Likewise, if the Platform includes links to third-party websites or resources, Brizz is not responsible for those external sites. Clicking external links (for example, an external ticket link or a reference link someone put in a description) means you are subject to that third party’s terms and privacy, not Brizz’s. We don’t endorse or assume liability for third-party sites or content.
  9. Content Backup: Users are encouraged to keep backup copies of their content. For instance, if you wrote a lengthy event description or uploaded photos, keep originals. We make reasonable efforts to protect data, but we cannot promise against data loss. In the event of any data loss or corruption, we may restore from backups if possible, but the responsibility ultimately lies with you to have copies of anything important.
  10. Feedback: If you send suggestions, ideas, or feedback about Brizz (e.g. feature requests or improvements), you agree that we can use and implement those without any compensation to you. You hereby grant us a perpetual license to incorporate and use any feedback you provide, and we will not treat it as confidential. (We appreciate it, of course, and it’s used to make Brizz better.)

In short, you own your content but give Brizz broad permission to use it for running and promoting the service. You promise your content doesn’t violate laws or others’ rights, and we can remove content that does. Both users and Brizz have roles in keeping the content on the Platform legitimate and respectful of IP rights.

10. Liability and Disclaimers

This section limits the liability of Brizz (Ananthya GmbH) to you. Please read carefully as it impacts your legal rights. Nothing in this section is intended to limit liability beyond what is permitted by applicable law, especially with respect to consumer rights; rather, it clarifies the allocation of risk and the extent of promises made.

  1. Platform Nature – "As Is" Basis: Brizz provides the Platform "as is" and "as available". While we strive to provide a great service, we make no express warranties or guarantees that the Platform will always be available, error-free, secure, or that it will meet your expectations. To the fullest extent permitted by law, we disclaim any implied warranties, such as merchantability, fitness for a particular purpose, and non-infringement. For example, we do not guarantee that using Brizz will generate any particular outcome for you (like success of your event or rental bookings), or that communications through the Platform will always be delivered promptly, or that the data on the Platform is accurate or up-to-date (some content is user-provided, after all).
  2. No Guarantee of User Conduct: Brizz does not guarantee the actions or performance of other users or third parties. We are not liable for the behavior, quality, or legality of the events organized by users, the services offered by users, or rentals provided by users. Users enter into transactions at their own risk. For instance, we are not responsible if an Organizer fails to hold an event as promised (beyond refunding the ticket price), or if a service provider’s work is unsatisfactory, or if a rental property has issues. Any remedy for those situations lies between the parties involved (attendee vs organizer, etc.).
  3. Limitation of Liability: Brizz (Ananthya GmbH) and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: (a) your access to, use of, or inability to use the Platform; (b) any conduct or content of any user or third party on or via the Platform (including offensive, illegal, or defamatory behavior); (c) any content obtained from the Platform (reliance on information on listings, etc.); and (d) unauthorized access, use, or alteration of your transmissions or content.
  4. In jurisdictions that do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, the above limitations may not fully apply to you; in such cases, Brizz’s liability is limited to the minimum extent permitted by law.
  5. Cap on Liability: To the extent permitted by law, the total cumulative liability of Brizz to you for any claims arising out of or relating to these Terms or the use of the Platform is limited to the greater of: (A) the total amount of fees (if any) you paid to Brizz in the 12 months prior to the event giving rise to the liability, and (B) EUR 100. This means if, for example, you have some claim that Brizz didn’t deliver a service properly, our maximum responsibility is refunding what you paid us, or €100, whichever is higher. If you paid nothing (e.g., just browsing or using free sections), our potential liability is capped at €100.
  6. Exception: This cap does not apply to cases of our intentional misconduct or gross negligence or other liabilities that cannot be limited by law (explained below).
  7. Statutory Exceptions (Germany/EU): Nothing in these Terms shall limit or exclude liability for: (i) death or personal injury caused by negligence, (ii) willful intent or gross negligence on our part, (iii) fraud or fraudulent misrepresentation, (iv) breach of any terms regarding title (like if we somehow sold you something and didn’t have title, which we generally don’t do), (v) any other liability that cannot be limited or excluded by law (such as liability under the German Product Liability Act, or certain warranty liabilities in the case of digital products to consumers), and (vi) your statutory rights as a consumer. For German users: In accordance with § 521 BGB and related provisions, for simple negligence, we only accept liability for breach of essential contractual duties (Kardinalpflichten) and then only to the typical foreseeable damage. Essential duties are those which enable the execution of the contract and on which you rely. For instance, an essential duty might be to provide the platform service in a minimal functional way. If we breach that by slight negligence, we’d be liable but limited to foreseeable damages (which likely aligns with the cap above). We are not liable for any other slightly negligent breaches. If you are a consumer, the statutory warranty rights for any digital services we provide remain intact to the extent they apply (though since we mostly connect users, there's limited "digital product" aspect beyond the platform itself). Also, any mandatory provisions of law (like under the Telemedia Act or Digital Services Act) that provide for liability in certain cases are not overridden by this clause.
  8. No Liability for Force Majeure: Brizz is not liable for failure to perform due to causes beyond our reasonable control, such as natural disasters, war, acts of terrorism, labor disputes, internet outages, power failures, pandemics, or governmental action.
  9. Release: Because Brizz is not directly involved in user-to-user dealings, if you have a dispute with one or more users, you release Brizz (and our affiliates and personnel) from claims, demands, and damages of every kind and nature arising out of or in any way connected with such disputes. For example, if you have a falling out or contract dispute with an event organizer or a service provider, you agree not to hold Brizz liable for it. We might assist in mediation informally, but ultimately it’s not our legal responsibility.
  10. Indemnification: (Covered in Section 11 below, but note that you also indemnify us which is sort of the flip side of us limiting liability.)
  11. Third-Party Liability Exclusions: Under the EU e-commerce framework and DSA, Brizz, as an intermediary service, generally isn’t liable for user-uploaded content or listings unless we have been made aware of specific illegal content and failed to act. We do not assume liability for any content provided by users, and we are not liable for the information stored at the request of users, as long as we have no actual knowledge of illegal activity/content. Once we are notified with proper substantiation of unlawful content, we will act expeditiously to remove or disable it, in line with the safe harbor provisions. This essentially means: if someone posts something illegal or harmful and we didn’t know, you can’t hold us liable just for being the host of that content. We follow notice-and-takedown rules diligently.
  12. No Professional Advice: Any information or materials (like blog posts, community forum answers, etc.) that may appear on Brizz are for general informational purposes and do not constitute professional advice (legal, financial, medical, etc.). Users should consult appropriate professionals for advice. Brizz isn’t liable for actions taken based on information on the platform that turned out to be inaccurate or unsuitable.
  13. Telephone/Messaging (WhatsApp) Use: If we enable features that allow communications via phone or messaging apps between users (like revealing a phone number for WhatsApp), we disclaim liability for any carrier charges or issues. Also, any voice/video call or message between users is outside our system; we aren’t recording or moderating those, so we aren’t liable for anything said or done there. Use caution just like you would outside the platform.
  14. Overall: You acknowledge that the limitations of liability and disclaimers in these Terms are a fair allocation of risk between you and Brizz, given that we offer a platform that largely relies on user contributions. The platform fees, if any, are set in reliance on these limitations. Without them, the terms might be different (likely more expensive or restrictive). This section shall survive termination of your account or these Terms.

In essence, Brizz’s liability to you is highly limited. We will do our best to run things well, but we cannot take financial responsibility for everything that could go wrong in a marketplace of this nature. By using the Platform, you accept that you bear the primary risk for your interactions and transactions with other users, and that our liability is restricted as set out above.

11. Indemnification (User’s Responsibility for Claims)

You agree to indemnify, defend, and hold harmless Brizz (Ananthya GmbH) and its affiliates, and each of their respective officers, directors, employees, partners, and agents (collectively, "the Brizz Parties") from and against any and all third-party claims, liabilities, damages, losses, and expenses (including reasonable legal fees) that arise out of or are related to:

  1. Your use of the Platform or services obtained through the Platform (for example, if you host an event and someone is injured and sues Brizz claiming it was negligent to allow your event, you would indemnify us).
  2. Your breach of these Terms or of any applicable law or regulation (for example, if you violate GDPR by misusing attendee data you got from Brizz and there’s a penalty or lawsuit, or if you fail to honor a refund policy and a consumer authority fines Brizz, you cover those costs).
  3. Your content that you post (for instance, if you uploaded a photograph without permission and the copyright owner takes legal action against Brizz, or if your listing description defames someone and we get sued).
  4. Your interactions or contracts with other users, including any injury, loss, or damage of any kind arising in connection with such interactions (e.g., a dispute between an attendee and an organizer, or a service provider causing damage at a client’s property and the client tries to rope Brizz in legally).
  5. Any claim that you have violated any rights of a third party, such as intellectual property rights or privacy rights (for example, using someone’s trademark in a way that confuses people and we get a demand letter).
  6. Taxes and regulatory compliance: If you as an Organizer/Provider fail to collect/remit taxes, or get your account flagged for tax issues and Brizz is drawn into it (maybe via an audit or as a responsible party under some marketplace tax rule), you agree to indemnify us for any liabilities or expenses incurred as a result. You are also responsible for any fines or penalties imposed on Brizz due to your violations (e.g., if your rental listing causes a city to fine us for not removing it when it was illegal, but we had no notice).

This indemnification obligation includes paying for Brizz’s legal defense of any such claim (with lawyers of our choice) as well as any settlements or judgments. We will try to notify you promptly of any claim and cooperate reasonably (at your expense) in the defense. You have the right to assume defense of the claim, provided you give us assurance of your financial ability to cover it and handle it diligently and not prejudicing Brizz’s reputation or interests. We reserve the right to participate in the defense with counsel of our own choosing at our own expense, and to approve any settlement that requires an admission of fault or imposes any obligations on Brizz (which you shouldn’t agree to without our okay).

In simpler terms: If your actions cause Brizz to be sued or incur costs, you will cover those costs. This is a standard allocation of responsibility in user-generated content platforms. It doesn’t mean we’ll automatically blame you for anything; it just means if a neutral third party comes after us for something that was really due to you, you step into our shoes financially. This also discourages misuse of the platform.

This indemnity survives any termination of these Terms or your use of the Platform, meaning even if you delete your account, if later a claim arises from when you used Brizz, this still applies.

12. Suspension, Termination, and Account Measures

Brizz reserves the right to suspend or terminate your account or access to the Platform if you violate these Terms or engage in behavior that is unlawful or that we believe in good faith is harmful to our community, third parties, or our business. Here’s how this works:

  1. User Termination: You may terminate your agreement with Brizz at any time by deleting your account or giving us notice (e.g. via email to support) that you no longer wish to use the Platform. If you terminate, any current pending transactions (event tickets, service bookings, etc.) may also be canceled if you request (attendees would be refunded, or provider bookings cancelled as applicable). We recommend completing or resolving any outstanding obligations before closing your account. Upon termination by you, we will deactivate your profile and cease displaying your content, but note that some content (like reviews you left or forum posts) might remain in an anonymized form, and we retain data as described below.
  2. Brizz Suspension/Termination: We may suspend (temporarily disable) or terminate (delete or permanently bar) your account in the following (non-exhaustive) cases:
  3. If you materially breach these Terms or any referenced policies (for example, posting illegal content, not adhering to Section 4's rules, repeatedly failing to fulfill transactions, abusing other users, etc.).
  4. If you provide false information or we cannot verify any information you provided and it’s necessary (like a fake name with malicious intent).
  5. If we receive multiple serious complaints about you from other users (even if each on its own might not be a clear violation, a pattern can cause action).
  6. If you engage in fraud or suspected fraud (e.g., charging for events and not delivering, using stolen credit cards).
  7. If required by law or at the direction of law enforcement or other authorities (for instance, if a court order requires us to ban you).
  8. If you haven’t used your account for a long period (say, over 1 year of inactivity) and your account has no active transactions, we might remove it after notice to free up usernames or comply with data minimization principles.
  9. If you repeatedly infringe intellectual property rights (as per our copyright policy).
  10. If your continued use might subject Brizz to legal liability or harm (for example, you’re doing something that could get us in legal trouble, even if unintentionally).

In most cases, for minor issues we will try to warn you and give you a chance to fix the problem (except obviously egregious cases or emergencies). For example, a warning email for a first policy violation. However, for serious breaches, we might disable your account immediately.

  1. Effect of Suspension/Termination: If your account is suspended, you cannot use the Platform (or certain features) until reactivated. If terminated, your right to use the Platform ceases immediately. You must not circumvent a ban by creating a new account or using someone else’s account. We may implement technical measures to enforce bans (like blocking an email, phone, IP). We reserve the right to also cancel any upcoming transactions:
  2. If you were an Organizer with upcoming events and we terminate for cause, we may cancel the events on the platform and refund ticket holders (and you will be required to return any payout, as per Section 5).
  3. If you were a service provider or host with bookings, we’ll notify the other parties and cancel those bookings where possible, to protect them (they will get refunds).
  4. If you were an attendee or guest with upcoming bookings and you did something to get terminated (e.g., harassed someone), we might cancel your tickets or bookings (possibly without refund if the cause was fraud or similar on your side—this we’d handle carefully, but let’s say you used a stolen card to book, those get canceled).
  5. Data and Access Post-Termination: Once terminated, you will lose access to any content, messages, or information associated with your account. We strongly suggest you download or save any information you need before terminating (like invoices, communication history) because after deletion you might not retrieve it. However, Brizz will retain certain data as required or permitted by law:
  6. We keep transactional records (payments, receipts, event logs) for at least the legally required time (e.g., 10 years for German financial records) to comply with financial regulations and in case of disputes.
  7. We keep data to enforce our rights (e.g., we may keep evidence of your violations to defend against future legal claims or to inform you if you attempt to re-register that you’re not welcome).
  8. Personal data will be handled in accordance with our Privacy Policy even after termination. We will either delete or anonymize data that we no longer need to keep. For example, your profile info may be deleted within a reasonable period, but a review you wrote might be anonymized as “Former User” rather than completely erased if it’s needed to maintain credibility of reviews.
  9. If your account was terminated for cause, we may also keep your email or phone in a suppression list to prevent re-creation. This is a legitimate interest to protect our platform from evasion of bans.
  10. Appeals: If you believe your account has been suspended or terminated in error, you can contact Brizz support to appeal. Under the Digital Services Act, business users in EU also have the possibility of an internal complaint-handling system or mediation for certain disputes. We will provide a clear channel for appeals (likely an email or form). In your appeal, explain why you think the action was mistaken or how you’ve corrected the issue. We will review in good faith and reinstate if appropriate. Our decision on an appeal is final within our Platform, but this doesn’t prejudice any legal rights you have under law (for instance, you could seek redress in court if you truly think we terminated you unlawfully, but we hope to resolve it amicably).
  11. Account Takeover or Death: If you become incapacitated or pass away, a verified legal representative or estate executor may contact us to request account closure or access. We’ll cooperate in line with privacy and legal requirements (e.g., might need proof of authority like power of attorney or death certificate and proof of executor status). Under German law, contracts are heritable, so theoretically your estate might handle closing things out. We will handle these on a case-by-case basis sensitively.
  12. Effect on Content: Upon termination, your user profile and listings will typically be removed from public view. We might display a generic message “This user is no longer active”. Any content that is removed might persist in backup copies for a time. If any content you posted remains (like forum posts that were replied to), it could be attributed to "Deleted User" or similar, without your personal details.
  13. No Right to Use After Termination: You agree not to try to use the Platform if you have been terminated. This includes not creating a new account with a different name. If we find you again, we have the right to terminate you again immediately without notice.
  14. Brizz’s Right to Discontinue: Separately, Brizz reserves the right to discontinue or modify the Platform (in whole or in part) at any time. This could mean we shut down the service entirely (hopefully never, but if so, we’d obviously provide notice and help wrap up open transactions). In the event of a planned discontinuation, we’d notify users in advance to allow events or bookings to conclude or for refunds to be processed.

Note: Termination of your account does not automatically extinguish any financial obligations you incurred (if you owe someone money or need to refund tickets, that still holds) nor does it automatically wipe out any liability you may have caused. Sections of these Terms that by nature survive (like indemnities, liability limits, etc.) will survive termination.

In summary, Brizz can remove users who violate rules to protect the community, and users can leave anytime as well. After termination, certain data handling and responsibilities persist as described. We aim to use termination only when necessary and fair.

13. Miscellaneous

This section covers various additional terms that don’t fit elsewhere but are important to outline:

  1. Governing Law: These Terms and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with them or their subject matter shall be governed by and construed in accordance with the laws of Germany. If you are a consumer resident in the European Union, this choice of German law may not deprive you of any mandatory consumer protections under the laws of your country of residence; you are entitled to such protections regardless of what we choose as governing law. For example, if you live in France, you might have certain rights by French consumer law in addition to what's in these Terms, and those would apply. But for all contractual interpretation and any issues not covered by mandatory law, German law will be used.
  2. Jurisdiction: You and Brizz agree that the courts of Frankfurt am Main, Germany shall have exclusive jurisdiction over all disputes arising from or related to these Terms or your use of the Platform, provided that if you are a consumer (as per EU definition) living in an EU member state, you may also bring proceedings in your country of domicile and any litigation will be in that country’s courts if required by applicable law. Also, if required by law, we might only be able to bring a claim against a consumer in their home country. Essentially, for B2B or users not protected as consumers, Frankfurt courts are chosen; for consumers, this clause doesn’t override rights to sue or be sued in home forums under EU law.
  3. Alternative Dispute Resolution: Brizz is not currently obligated to and does not participate in any formal alternative dispute resolution (ADR) process with any consumer arbitration body. However, under EU law, we inform consumers that the European Commission provides an Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr, which you can use to attempt to resolve disputes. Our contact email for any dispute resolution is included in our legal info (e.g., support@brizz.me). Keep in mind, this ODR tends to forward issues to national ADR bodies, and as said, we are not obliged to use those, but the option is there. We prefer you contact us directly to work things out amicably.
  4. No Class Actions (if applicable): To the extent permitted by applicable law, you and Brizz agree that each may bring claims against the other only in an individual capacity and not as a plaintiff or class member in any purported class or representative action. (Note: If you’re a consumer in certain jurisdictions, class action waivers might not be enforceable, so this applies where it can. Germany, for example, doesn’t really do class actions in the US sense, so it’s mostly relevant elsewhere.) There is no class-wide arbitration or litigation agreed here.
  5. Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be eliminated or limited to the minimum extent such that the remainder of the Terms will continue in full force and effect. In German terms: if any clause is unwirksam (ineffective), the rest remains binding, and if needed, an effective provision that comes closest to the intent of the invalid one will be substituted by law (as per § 306 BGB). But this severability should not result in a significant alteration of the essence of the agreement unless absolutely required.
  6. No Waiver: Brizz’s failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be explicit and in writing to be effective. For example, if you violate a rule and we don’t take immediate action, that doesn’t mean we can’t later or that you’re allowed to keep violating it.
  7. Entire Agreement: These Terms (including any referenced Additional Policies, such as our Privacy Policy, Community Guidelines, etc.) constitute the entire agreement between you and Brizz regarding your use of the Platform, and supersede any prior agreements or understandings (whether oral or written) relating to the subject matter. You acknowledge that you have not relied on any representation, warranty, or statement not expressly set out in these Terms.
  8. Relationship of Parties: Nothing in these Terms shall be construed as making either party the partner, joint venturer, agent, legal representative, employer, or employee of the other. Brizz and users are independent contractors to each other. You have no authority to make or accept any offers or representations on behalf of Brizz. For instance, as an Organizer, you cannot claim you are "Brizz staff" or bind Brizz to any third-party obligations.
  9. Transfer and Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. Brizz may assign or transfer this agreement, including all rights and obligations, to any third party in connection with a merger, acquisition, sale of assets, or by operation of law or otherwise, and by continuing to use the Platform you consent to such transfer. We would notify users of any such change who the new operator is if it materially affects service.
  10. Changes to Terms: We may revise these Terms from time to time. If we make a material change, we will notify you via a prominent notice on the Platform or via email (depending on preference or necessity) in advance. The updated Terms will take effect after the notice period (we comply with any applicable notice requirements; for private consumers in EU, typically at least 15 or 30 days notice for significant changes). If you do not agree with the revised Terms, you may terminate your account before the changes apply. Continued use of the Platform after the effective date of new Terms constitutes your acceptance of them. The "Last Updated" date at the top indicates when Terms were last changed.
  11. Language: These Terms are provided in English (as a common language for our international users). If we provide translations, those are for convenience. In the event of any discrepancy between the English version and a translated version, the English version prevails for interpreting these Terms, to the extent not prohibited by local law. (However, note for German consumers, we might supply a German translation too which would likely be equally authoritative; but since this is in English as primary, we mention this.)
  12. Notices: Official notices to Brizz (such as legal notices) should be sent to our registered business address (which will be provided in the Impressum: e.g., Ananthya GmbH,Gerlachstr. 4, 65929 Frankfurt am Main, Germany) with a copy by email to our legal contact if provided. Notices to you will be given via the email associated with your account or via the Platform interface or notifications. It’s your responsibility to keep your contact info current. Emails from us are considered received within 24 hours if sent to your email, or immediately when posted on our site.

  21. Headings: Section headings in these Terms are for convenience only and have no legal effect.
  22. Force Majeure: We already mentioned it in liability, but for completeness: Brizz is not liable for any delay or failure in performance resulting from events, beyond its reasonable control, such as natural catastrophes, government acts, internet failures, etc.
  23. Contact Us: If you have any questions about these Terms or need support, please contact our support team at or via the help center on the Platform.
